These General Terms and Conditions apply to the services and reservations offered by House of Spa (operated by HoS Beckenried GmbH, Obere Allmend 9, 6375 Beckenried), hereinafter referred to as “House of Spa.”
1. Conclusion of the Contract
By making a reservation, the guest makes a binding offer to House of Spa to book a stay. The reservation may be made in writing, in person, or by telephone. The person making the reservation is also responsible for all participants listed in the reservation and is liable for their contractual obligations in the same manner as for his or her own obligations. The contract is concluded upon acceptance by House of Spa.
Acceptance does not require any specific form.
2. Prices
Prices are final and include the applicable sales tax. In the event of a sales tax increase after the contract is signed, La Spa Suite reserves the right to adjust prices accordingly.
Any type of gift certificate, promotion, or discount is only valid if it has been registered and confirmed in advance.
3. Cancellation
House of Spa and the customer are entitled to cancel the reservation for the reserved premises.
Notice of withdrawal from or amendment to the contract must be provided in writing.
3.1. Free of charge: Complete cancellation of the reservation or rescheduling
You may cancel the entire contractually agreed reservation free of charge under the following conditions:
Up to 14 days before the booking date: 100% refund in case of cancellation
3.2. Cancellation Fees for Reservations
Up to 10 days before the booking date: 50% refund in case of cancellation
Up to 5 days before the booking date: no refund in case of cancellation
The reservation fee is due only if House of Spa is unable to rent the canceled space to another party.
4. Payment
For reservations, a prepayment is due prior to arrival. If this prepayment is not made, House of Spa is entitled to cancel the contract. In this case, the guest is obligated to pay a penalty equal to 50% of the total amount due.
5. Force majeure and threats to the smooth operation of the business, the safety, or the reputation of House of Spa
In the event of circumstances beyond House of Spa’s control—such as fire, natural disasters, strikes, lockouts, or supply shortages—La Spa Suite reserves the right to terminate the contract. The right to terminate the contract also applies if a reservation threatens to jeopardize House of Spa’s smooth business operations, safety, or reputation. In such cases, the assertion of any claims for damages against La Spa Suite is excluded.
6. Liability
House of Spa assumes no liability for items and valuables brought in by the guest, unless House of Spa can be proven to have acted with intent or gross negligence. The guest is only entitled to set off or withhold payment against counterclaims that are undisputed or have been legally established. The guest is obligated to report the loss of any items brought onto the premises to House of Spa immediately, or at the latest upon departure. The guest is liable for all damages caused by him or her during the agreed period of use.
7. Changes to the Agreements
Any amendment to a written agreement must be made in writing.
8. Final Provision
Should any provision of these Terms and Conditions be invalid, this shall not affect the validity of the remaining provisions. The invalid provision shall be replaced by a valid provision that most closely reflects the economic purpose intended by the contracting parties. The place of performance and venue shall be Beckenried, Switzerland.
